Terms and Conditions

This agreement is a legal document which sets out your rights and obligations, and those of Image Artwork, in relation to the products Image Artwork sells to its consumers.

Effect of this Agreement
|
Viewing of the Image Artwork website is free. However when you register for the site you agree to the terms of this agreement, and you re-affirm that agreement each time you use Image Artwork's services. We recommend therefore that you read this agreement to become familiar with the rights and obligations within it.

Applicable Law
|
Image Artwork is a company registered in England, and each sale shall be deemed to be performed in England. English law shall govern each transaction, including (without limitation) all contractual and other relationships, which arise as a result of such sales. You the consumer and Image Artwork will submit to the non-exclusive jurisdiction of the English courts in relation to any disputes arising out of any sale.

Making a Contract with Image Artwork
|
In return for the excellent service Image Artwork will provide we ask that you agree to register all Image Artwork sales using your correct name, address and any other requested details. You may be asked to enter credit, debit or credit card details. You must ensure that (a) you are fully entitled to use that card at the time you provide those details to Image Artwork, and subsequently when using the card, and b) that the card has available funds to cover all charges incurred on it during the course of purchasing products from Image Artwork. If any of the information you provide becomes incorrect or is superseded, then you must notify us with the correct information immediately. In any event, to register for Image Artwork services, you must legally be able to enter into contracts for products that you may buy here. Generally, this means that you must be at least 18 years old.

Misuse of Image Artwork's Website
|
Image Artwork reserves the right to suspend or terminate any members account which is, or appears to us in our absolute discretion to be, in breach of any of the provisions of this agreement.

Copyright
|
The images used in the designs of Image Artwork are the property of the owner. However, the designs and styles to which they are manipulated are the property of Image Artwork. You must not use, reproduce, modify or distribute our images or any part of those images, in any manner whatsoever. In the event that there is any dispute between Image Artwork and you the consumer in relation to this issue, you agree that until the matter is resolved, an interim injunction will be the appropriate course of action. An Interim injunction is a court order, which will prevent any further use or distribution of the image in question, until a final court hearing is set, where the court will make a decision based on all the facts available.

Loss
|
Please be aware that Image Artwork will not be liable to you or any third party for any indirect loss or damage, or for any loss of data, profit, revenue, business or management time, however caused.
|
You also agree that the liability of Image Artwork under this agreement (whether arising in negligence or otherwise), will not under any circumstances exceed the greater of a) £500 or b) an amount equal to the sums paid or payable by you. This does not affect your statutory rights as a consumer.

Consequential Loss
|
In the event of consequential loss, Image Artwork will only be responsible for the cost of your order.
|
Reasonable Control
|
Image Artwork shall not be liable for any failure to perform its obligations under this agreement if caused by matters beyond our reasonable control.

Changes to this Agreement
|
Image Artwork reserves the right to update the terms of this agreement from time to time, and post a new version on the Image Artwork website. The new version will take effect from the day of posting on the website. Price and availability information are also subject to change without prior notice.

Security and Privacy
|
With regards to any security or privacy concerns, Image Artwork would like to reassure you that any information you provide to us throughout the registration will be well protected. We also feel it important you know exactly how information you provide us with is used and that all information is collected lawfully and in accordance with the Data Protection Act 1998.

How Image Artwork Use Your Data
|
The privacy policy forms part of the agreement between Image Artwork and you the consumer, and by purchasing goods from the Image Artwork website, you agree to be bound by the terms and conditions of the agreement between us. You also give your consent to the way in which Image Artwork handle your personal data as stated in this policy statement. Image Artwork will not use this data, or disclose it to any other party, either during registration or at any other time, without your express permission.

Image Artwork may also contact you in respect of special offers or competitions, but only if you have elected to receive this by checking the opt-in box during the registration procedure, or entered your email address on the home page mailing list submission. You may unsubscribe from our contact list at any time by replying to a promotional email with the word "unsubscribe" in the subject line or by e-mailing us at info@imageartwork.co.uk.

To provide a service that meets our customer needs, we may collect personal data relating to the popularity and usage of particular aspects of the Image Artwork website. However this data will be used or aggregated on an anonymous basis only.
